Definition of Class

To coordinate, oversee, and direct the judicial functions of the City of Alcoa Municipal Court; lead and perform professional judicial duties in the interpretation, application, and enforcement of Tennessee statues, City charter, and local ordinances. Presides at a variety of trials, hearings, and other judicial proceedings; and administer justice fairly and impartially in accordance with all applicable Municipal, State, and Federal laws.

Essential Duties Performed

  • Holds and presides over municipal court hearings; and makes rulings on civil ordinance violations in non-jury trials.
  • Responsible for keeping or causing to be kept a court docket(s) embodying complete detailed records of all cases handled in the municipal court and may authorize the Chief of Police to maintain and keep such records.
  • Advises counsel, litigants or Court personnel on Court procedures; administers the judicial system; and settles disputes between opposing parties or their counsel.
  • Establishes rules of procedures for which standard procedures have not been established.
  • Listens to presentation of cases; and rules on the admissibility of evidence and methods of conducting testimony.
  • Responsible for municipal court administration as set forth in Title 3, chapters 1-5, of the Municipal Code.
  • Responsible for recording and enforcing the collection of all fines, costs, and forfeitures imposed in the municipal court.
  • Reviews new laws, major court decisions, and other pertinent information relevant to the interpretation or revision of Court rules, judicial precedence, or local laws.
  • Performs a variety of administrative duties. Reviews potential complaints, fine schedules and local rules.
  • Rules on motions filed with the municipal court and prepares orders as needed.
  • Performs other related duties as required.
  • Ensures all behaviors comply with the City’s Personnel Rules and Regulations and with the Tennessee Rules of Judicial Conduct.

Minimum Education Requirements

Juris Doctor Degree from an accredited college or university and minimum of ten (10) years of increasingly responsible experience practicing law, in the State of Tennessee.  Court experience along with municipal related knowledge is preferred.

 

OTHER REQUIREMENTS

Possession of valid license as an attorney issued by the State of Tennessee, and a member in good standing of the State Bar of Tennessee.

  • Knowledge of operations, services and activities of a Municipal Court.
  • Working knowledge of practices and procedures of civil, criminal, constitutional and administrative law.
  • Knowledge of principles and practices of public law, court procedures and rules of evidence.
  • Established precedents and sources of legal reference applicable to City activities.
  • Methods and techniques of legal research.
  • Methods and techniques used to question witnesses in trial situations.
  • Interpretation of pertinent Federal, State and local laws, codes and regulations.
  • Ability to research and become familiar with applicable local rules, Tennessee Rules of Evidence, Tennessee Penal Code, Tennessee Code of Criminal Procedures, Tennessee Traffic Law, Tennessee Animal/Health Law and City of Alcoa Municipal Code.
  • Communicate clearly and effectively, both orally and in writing.
  • Assume responsibility for all various judicial services and activities.
  • Interpret and apply legal principles and knowledge of complex legal problems.
  • Review new laws, major court decisions and other pertinent information relevant to the revision of Court procedures and operations.
  • Always maintains professionalism.
